Terms of Service
These Terms govern Focuddle software, automated digital character creation and related services provided by , operating as Focuddle (), at .
1. Eligibility and account information
You must be legally capable of entering a contract and provide truthful information. A parent or legal guardian must authorize use by a minor. You are responsible for maintaining access to your sign-in email or external identity and for activity through your authenticated session.
2. License
After valid payment, Focuddle grants you a personal, non-exclusive, non-transferable license to use the delivered desktop software and character package. You may not resell, sublicense, reverse engineer for redistribution, remove rights notices or use the service unlawfully.
3. Uploaded content and likeness rights
You retain rights you already hold in uploaded content. You represent that you own it or possess all permissions required to upload, transform, store and use it, including consent from depicted people. Do not submit protected characters, third-party artwork, trademarks, confidential material, deceptive celebrity likenesses or unauthorized images of minors.
4. Generated output and intellectual property
Automated output may be inaccurate, may resemble existing material or other users' output, and may not qualify for copyright protection without sufficient human authorship under the law that applies to you. Focuddle does not guarantee originality, exclusivity, copyright eligibility, trademark availability, registrability or non-infringement. Generation does not transfer third-party rights or make an unauthorized source lawful. You must review the selected identity, every action frame and any commercial name or branding before public, commercial or registered use, and obtain independent advice where the risk is material.
5. Payment and taxes
Checkout may be provided by Paddle as merchant of record. The checkout displays the final price, currency, applicable tax and available payment methods. Your purchase is also subject to the checkout provider's buyer terms.
6. Automatic delivery
Standard software is delivered by download. Paid character packages are generated and supplied electronically through an automated process after successful payment and receipt of a supported source image. No human review, manual illustration or revision service is included.
During the pre-payment test period, signed-in customers may receive a personalized Windows test executable for a completed work without checkout. The executable may require one first-launch HTTPS activation to retrieve the selected generated image, after which the image is stored locally. Test access does not promise that future paid tiers, animation states, signing status or platform support will remain unchanged.
7. Customer workspace
Signed-in customers receive a private workspace subject to the displayed storage quota, generation limits and reasonable technical restrictions. Uploaded images are safely normalized before storage. Active source images and generated results remain available until the customer deletes the work or closes the account, subject to service availability and these Terms.
8. Export, trash and deletion
Customers may download individual files, export active works, move works to trash, restore them and permanently delete them. Trash is normally retained for 30 days. Permanent deletion and account closure cannot be reversed after active files and available backups have expired.
9. Acceptable use
Do not use Focuddle for infringement, impersonation, deception, harassment, defamation, unlawful surveillance, sexual exploitation, malware, attacks on other users, storage abuse or evasion of safeguards.
10. Optional desktop analytics
The desktop application offers a separate optional setting for limited first-party usage analytics used to measure active installations, reliability and feature use. The setting is not required to use purchased or generated companions and may be withdrawn at any time. The categories collected and excluded are described in the Privacy Policy.
11. Suspension
We may refuse or suspend accounts, storage or automated processing where content or behavior appears unlawful, infringing, deceptive, unsafe or abusive. Where appropriate, a remedy will be handled under the Refund Policy.
12. Warranty and liability
The service is provided with reasonable care but without guarantees not expressly stated here. Online storage is not a substitute for the customer's own backup of important files. Nothing excludes rights or liabilities that applicable law does not permit us to exclude.
